Obligation to Appoint a Representative in Türkiye for Foreign Data Controllers
Pursuant to Article 11 of the Regulation on the Data Controllers’ Registry under the Law No. 6698 on Turkish Personal Data Protection Law (“KVKK”), natural and legal persons not residing in Türkiye but processing personal data in Türkiye are obliged to appoint a data controller representative within Türkiye. This representative is responsible for completing the VERBIS registration of the foreign data controller, responding to data subject requests within Türkiye, and maintaining communication with the Turkish Personal Data Protection Authority.
As of 2025, administrative fines ranging between TRY 272,380 and TRY 13,620,402 are foreseen for data controllers who fail to comply with the VERBIS registration and notification requirements.
